A Division Bench of Justices Pankaj Mithal and Saurabh Lavania has directed both the authorities to file their counter affidavits within six weeks, “clearly indicating the measures or the schemes they propose to undertake for maintaining clean atmosphere and what measures are being taken on the issue of reducing air pollution.” The direction has come in a PIL filed by Advocate Radhika Singh, concerned regarding air pollution and for prevention of smog. She had sought for a complete ban on firecrackers and had urged that some other effective measures may be adopted so that air quality is maintained. It may be noted that presently, the firecracker ban as imposed by NGT is not applicable to places where air quality is moderate or below. “Citizens Are Entitled To Breathe Fresh Air”: NGT Bans Sale/ Use Of Firecrackers In Delhi NCR And Places All Over India With Poor/ Worse AQI The present petition has been tagged with another PIL titled Anagh Mishra v.
